Buying a home will probably be the largest and most significant purchase you will make in your life.  Perhaps the most important reason to be represented by an attorney is conflicting interests of the parties.  Clearly, the buyer’s and seller’s interests can be at odds, but what about the interests of the brokers involved in the sale?  True, your agent’s sole task is to look out for your interests, but being that they are not getting paid until the deal goes through, that might not always be the case.  Further, most laws protect the agents – after all – they have a professional association with the clout to lobby our legislature for new laws.

Worse, who is looking out for you if your realtor has directed the whole process, such as in-house financing, or an in-house title company?  While this could be good customer service, this also creates an atmosphere where every link in the chain is focused on going to closing to get paid – not protecting you.  Unfortunately, in such circumstances, you might need to look beyond your agent for help and your lawyer’s only job is to protect you.
